Subscription, Payment, and Refund Policy

• Subscription Models: GetIdol offers two primary payment models: a monthly subscription and a pay-as-you-go option using tokens.
• Payment Terms: You agree to timely pay all fees associated with your chosen subscription model.
• No Refund Policy: Due to the immediate consumption of digital content, all payments made to AI Chat Software. for use of the GetIdol services are non-refundable.

User-Generated Content and Rights

• Content Responsibility: You are responsible for ensuring that the characters and content you create comply with these Terms and do not infringe upon others' rights.
• Image Use Policy: We modify submitted images to prevent exact replication of original faces.
• Privacy Protection: Created Idols should not infringe on real-world people’s privacy. They should represent made-up people.
• Intellectual Property: You must own or have rights to the images and content submitted on our platform.

Prohibited Activities and Conduct

When using the Services provided by GetIdol and AI Chat Software., you also agree not to submit any content or engage in any activity that:

• Contains harmful software such as viruses, or any code or program that might interrupt, damage, or limit the functionality of any computer software, hardware, or telecommunication equipment.
• Poses a risk to anyone's privacy or security.
• Is a form of unsolicited or unauthorized advertising, promotional materials, or solicitation, including but not limited to junk mail, spam, chain letters, pyramid schemes, contests, or sweepstakes.
• Involves the exploitation or abuse of minors, including any content related to child sexual exploitation or abuse, grooming, or sexual extortion.
• Is deemed objectionable by AI Chat Software., restricts or inhibits others from using or enjoying the Services, or poses a risk of harm or liability to GetIdol, AI Chat Software., or its users.

In using the Services provided by GetIdol and AI Chat Software., you agree to refrain from the following actions:

• Disregarding or failing to comply with any requirements, procedures, policies, or regulations of networks associated with the Services.
• Breaching any applicable laws or regulations.
• Falsely impersonating any individual or entity, or falsely representing your association with any individual or entity.
• Soliciting personal information from individuals under 18 years of age.
• Harvesting or collecting email addresses or other personal contact information of other users from the Services, for the purpose of sending unsolicited emails or other types of unsolicited communications.
• Attempting to access or acquire any information or data through means not deliberately provided or made available through the Services.
• Leasing, lending, selling, or sub-licensing any part of the Services without authorization.
• Attempting to bypass or circumvent any security or protective measures related to the Services or any associated technology.
• Reverse engineering, disassembling, decompiling, decoding, modifying, or attempting to extract the source code of the Services, in whole or in part, except where such actions are expressly permitted under an open-source license applicable to parts of the Services' code.

• AI Chat Software., through its GetIdol service, is not liable for any content or materials produced by third parties, including AI characters ("Idols") and their generated content ("Generations"). This includes, but is not limited to, potential infringement of intellectual property rights, any errors or omissions in content, and any loss or damage incurred from using such third-party content. It's important to recognize that we do not pre-screen content and AI-generated interactions can be unpredictable. As a user, you are responsible for assessing and bearing all risks associated with using any third-party Content or AI-generations. Relying on the accuracy or completeness of such content is at your own risk.
• We reserve the right, though not the obligation, to remove or refuse any content available via the Services at our sole discretion. This includes, but is not limited to, content that violates these Terms or is otherwise deemed objectionable by us.

This grant is made to the fullest extent permitted under law and enables GetIdol to fully utilize the creative potential of your Idols and their AI generations while maintaining your ownership rights.

Dispute Resolution

• Arbitration Agreement: Disputes arising under these Terms will be resolved through binding arbitration.
• Governing Law: These Terms are governed by the laws of the jurisdiction in which AI Chat Software. parent company is located.

Copyright Violations

GetIdol, provided by AI Chat Software., respects the intellectual property rights of others and we expect our users to do the same. If you believe that your work has been copied in a manner that constitutes copyright infringement, or if your intellectual property rights have been otherwise infringed upon, please inform us about your claim.

Please understand and acknowledge that AI Chat Software., in relation to GetIdol, shall not be liable for any indirect, incidental, special, consequential, or exemplary damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages). These limitations apply whether the damages arise from the use or the inability to use the GetIdol Services; your access to, use of, creation of, or interaction with any content, Idols, or Generations; unauthorized access to or alterations of your transmissions or data; the conduct of any third party on the Services; or any other matter related to the GetIdol Services. The total liability of AI Chat Software. shall not exceed the greater of $100 or the total amount you have paid to AI Chat Software. for the use of GetIdol Services, if any.

It's important to note that some jurisdictions do not permit the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. As such, some of the above limitations may not apply to you. If you are dissatisfied with any aspect of the GetIdol site or these Terms of Use, your sole and exclusive remedy is to discontinue using the GetIdol Services.

We may suspend or terminate your access to the Services for various reasons, including violation of these Terms or inactivity.
